Job Description

Duties

The incumbent serves as a senior Policy and Law Advisor. The incumbent is responsible for developing new program objectives and legislative and regulatory initiatives to facilitate achievement of OLMS program goals and objectives; developing new programs to assist the OLMS national and regional offices in addressing reoccurring problems related to the administration and enforcement of laws under OLMS purview; proposing changes in the LMRDA, Federal transit law, and other laws administered and enforced by OLMS; planning, organizing, and determining the scope and depth of studies/projects for new and complex issues affecting OLMS stakeholders and consolidating findings into a completed product; serving as a project leader responsible for assigning segments of the project to various participants and coordinating the efforts of the group.

  • Develops and drafts regulations implementing provisions of the LMRDA and other laws administered by OLMS and interpretative bulletins, which set forth agency interpretations concerning those laws.
  • Develops and revises, as necessary, financial and other reporting forms and accompanying instructions authorized or required under the LMRDA and other laws administered by OLMS and incorporated in agency regulations.
  • Researches complex issues of law and fact; and, drafts final and binding arbitration decisions for the OLMS Director's signature. Reviews and analyzes statutes and executive orders to provide guidance to the agency concerning the implementation of new program assignments, and develops implementing regulations. Participates in planning meetings with high level OLMS and Department of Labor officials to develop goals, strategies, and implementing regulations and to coordinate agency implementation of such new programs.
  • Initiates reviews of the LMRDA Interpretive Manual which incorporates precedential court and agency rulings on interpretations and applications of the LMRDA, and other policy manuals, including the LMRDA Embezzlement Court Decisions Guide. Reviews entail identifying all areas needing updating, clarification or revisions; cross matching those areas with other related areas to ensure consistency and a cohesive workflow; working with other OLMS managers to resolve issues with minimal disruption to ongoing work and established procedures. Based on project reviews, recommends updates to the Manual and coordinates the development of associated revisions.
  • Provides technical advice and guidance to agency staff and others in regard to the most complex and difficult issues concerning administration of the LMRDA and other laws administered by OLMS, including complex statutory coverage, reporting, trusteeship, bonding, and election issues. Provides technical advice and guidance to national office and field staff on enforcement-related issues, such as subpoena enforcement, application of the Right to Financial Privacy Act, the Freedom of Information Act (FOIA), the Privacy Act, and criminal and civil law enforcement authority and procedures. Develops and updates comprehensive studies on court decisions under the LMRDA and other laws and on determinations by the Office of the Solicitor for the guidance of agency national office and field staff. As assigned, conducts and participates in staff training and develops information and material to be used for such training.
  • Coaches lower-graded policy and law advisors in the Division in the selection and application of appropriate problem solving methods and techniques, provides advice on work methods, practices and procedures, and assists the Division and/or individual policy and law advisors in identifying the parameters of a viable solution. Assists the Division Head in identifying, distributing, and balancing workload.

Qualifications

GS-0301-14 Grade Qualifications:
To meet the minimum qualifications for this position, you must have at least one (1) full year of specialized experience equivalent to at least the next lower grade level (GS-13) in the Federal Service, public interest, or private industry, that is directly related to the work of the position and has equipped you with the particular knowledge, skills and abilities to successfully perform the duties as a Policy and Law Advisor.

Specialized experience for this position includes: Experience advising on laws, rules, and regulations relating to U.S. labor laws.

Education

There is no education substitution for GS-14 grade level.
