Job Description

Duties

For GS-13:

  • Represents MSHA in meetings with representatives of industry and organized labor to discuss and/or gain acceptance of Agency proposals or insure full input in the regulation development process. Responsible for reviewing and analyzing comments received on proposed regulations and determining, in conjunction with technical program personnel, management and the Office of the Solicitor whether the issues raised by the comments have sufficient merit to warrant changes in the proposed regulation.
  • Performs literature research, gather facts, and develop materials that will be used for rulemaking.
  • Conducts continuing reviews and analyses of existing Agency regulations to identify those which may need revision in view of changing Agency requirements or policies or actions taken by other regulatory agencies (e.g. Nuclear Regulatory Agency, OSHA, or Office of Surface Mining) and provides this information to the Assistant Secretary and top MSHA officials as input into their regulations development functions.
  • Works with the Solicitor to consolidate relevant background and supporting justification for MSHA's position. Coordinates with the Office of the solicitor and Departmental personnel to ensure that proposed regulations meet all legal, Secretarial and Government-wide requirements and practices.
  • Drafts the most complex, controversial or sensitive regulations or assists personnel from the Office of the solicitor in drafting regulations pertaining to all MSHA program activities. Responsible for insuring that regulations reflect MSHA policies and are consistent with other Federal and State regulations to the extent possible. Exercises a leadership role in resolving any conflicts in this regard.
  • Exercises a leadership role to resolve any differences within MSHA or between MSHA and outside bodies.

Qualifications

For GS-13: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-12 in the Federal Service.

Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.

Specialized experience is defined as meeting all of the following:
  • Experience interpreting, developing, reviewing, preparing, and formulating, policy issuances, reports and statement required by law, Executive Order or regulation;
  • Experience writing and orally communicating the Agency's views and position to opposing parties;
  • Reviews proposed Agency policy issuances to ensure consistency with Agency goals and objectives; AND
  • Reviews and analyzes comments/inquiries on proposed regulations, recommending regulation changes.
There is no substitution of education in lieu of specialized experience at the GS-13 grade level.

This position is inside the bargaining unit. If the duty location is within the Washington, D.C. metropolitan area, the position will be included in the Local 12, AFGE bargaining unit.
